UGC can impose Terms to make Deemed Universities improve Quality: HC

The aim is to improve education by reducing involvement of family members in managing institutions


The Madras High Court has ruled that the UGC has the right to continuously impose conditions to make deemed universities maintain their quality as institutions of higher learning.

Justice K Chandru, dismissing petitions filed by 14 deemed to be universities and Tamil Nadu Deemed Universities Association challenging the UGC (institutions to be deemed Universities) Regulations 2010, said the institutions had willingly executed a memorandum agreeing to abide by the UGC guidelines and could not now go back on it.

The court said the concept of the trust founder or founder having power to bring his family members does not arise after having established the trust or society.

"Once a trust is established, the role of founder is not of a proprietor but to maintain the objectives and ideals for which the trust is formed. The founder is only a trustee and not proprietor."

Justice Chandru rejected the argument that family members of the founder, who has invested a huge amount in building the institution, could not be prevented from holding the post of chancellors and pro-chancellors.

He said the objective of the trust was to run educational institutions of higher learning and not to have direct or remote control over the said institutions.

"Control by family members will negate the very purpose of learning and jeopardise autonomy of the institutions, besides leading to an undesirable result as found out by a review committee appointed by the Centre," he said.

The UGC's review committee said the number of Deemed Universities had increased from seven in 1970 to 130 in 2010. Out of these, 87 had got the status of a university. Family members control the institutions, leading to undesirable practice for management of the universities.

Out of the 130 deemed to be universities, only 38 could justify themselves as deemed universities. All the 14 petitioners were not on the list of the 38 deemed universities.

The Hon Court’s judgment is correct, most deemed (doomed) universities are run by fascist family members who believe that they can make arbitrary decisions affecting the lives of students and faculty. The primary reason that universities and colleges are set up is to facilitate quality higher education and the initial amounts used by the trustees are usually set of against tax monies payable to the Govt. It is imperative that the Govt. regulate these universities and colleges; which again is in doubt, because most colleges and universities are under the patronage of local MLA's and MP's who use these teaching institutes to launder black money.

Excellent judgement by honble judge of madras high court
A corrupt people of India has been established private deemed university and earn and looted innocent public/student. A large no. of private deemed univesity is running in India thru balck money. It must be stopped now.

Deemed universities
The opinion expressed by the honble judge of madras high court is not going toe a progressive step towards attracting private participation in higher education. The trust is formed with certain objectives, only like minded people some times more than one family member constitute the trust. Only the trustees who join together know the objectives and the need to work towards achieving those objectives. The trusts need to collect contributions or spare their own resources to establish and run the trust. If they are expected to hand over every thing to some outside elements who will have no commitment towards the objectives, the entire exercise becomes futile resulting in mis management,mis appropriation, lack of financial support etc., if the trustees are fully qualified and have the capability why not? It is unfair, unthoughtful and non progressive action that is contemplated in the enactment.

Deemed universities
This is another setback for corrupt pepole. These trustees have lot of back money and not finding any place to save this money than openning deemed university.These people are politician who opened deemed university by giving bribe to mr. Arjun Singh & UGC chairman.
