New Annamalai varsity Act challenged

Mr. Ramasamy, a former Pro-Chancellor and descendent of the founder has challenged the Annamalai University Act 2013 in the Madras High Court

Mr. Ramasamy, a former Pro-Chancellor has filed a petition in the Madras High Court against the Annamalai University Act 2013. The new University act effectively rescinds the rights that were given to M.A.M. Ramasamy by a 1929 law. The First Bench with Acting Chief Justice R.K. Agrawal and Justice M. Sathyanarayanan have ordered notice and will have a further hearing on November 11.

Mr. Ramasamy has stated that the removal of the Annamalai University Act of 1929 has taken his rights and harmed his repute. The university was founded in 1929 by his grandfather and the 1929 Act allowed one adult male member of the founders family chosen by the Chancellor to hold the post of Pro-Chancellor.

He stated that the University was under financial duress in November last year because of policy decisions of the State and Central governments. He then went to the Higher Education Secretary asking that pending grants to the University be released in their time of need. He had also asked for additional grants to prevent future financial problems. However his request resulted in the new legislation instead.

He explained how the act was implicating him as being responsible for the maladministration in the University and for the malpractices alleged. He then stated that it was established that the reputation of a person could not be dishonored by the State without an opportunity to defend him. He concluded that the one-sided act of removing the post of Founder in the university is thus unconstitutional.
